TERMS & CONDITIONS
General
1. These terms and conditions together with any specific instructions on Afound´s Competition website www.afound.com ("Competition website") are the Competition rules ("Rules") and apply to the Birger 1962 competition ("Competition") held by H & M Hennes & Mauritz GBC AB, 556070-1715, SE-106 38 Stockholm, Sweden for its concept Afound ("Afound"). By uploading a photo of your best interior gem and motivate why with the hashtag #malenebirgerafound Instagram ("Entry"), each entrant ("you") enter the Competition and agree to be bound by these Rules and Afound's Privacy Policy found on Competition website. The Competition commences 10 am CET on 18/10/11 and closes at 00.00pm CET on 18/10/25. The winner will be announced on Afound's Instagram account no later than 18/11/01.
2. Afound may, acting reasonably and at its sole discretion, apply, interpret, terminate and make any minor changes to the Rules at any time. Any changes will be posted either within these terms and conditions or on our Competition website. The most recent terms and conditions will always be posted on our Competition website.
3. In the event of any dispute regarding the Rules or the results and all other matters relating to the Competition, the decisions are final and no correspondence will be entered into.
4. The Competition is in no way sponsored, endorsed or administrated by, or associated with Instagram, and you agree to a complete release of Instagram from any and all liability in connection with this Competition.
Qualifying Entrants
5. Employees, officers, directors, agents and representatives of Afound, or any of its affiliated companies within the H&M Group, are not eligible to enter the Competition. Afound reserves the right not to award a prize (and to select an alternative winner) if Afound is aware or has reasonable grounds to believe that a winner is not eligible.
6. The Competition is open to persons 18 years or older when entering the Competition, who are not under guardianship, with a residential address in Sweden. If you are aged under 18 years, Afound assumes (and you warrant) that your parents have given their consent to you entering the Competition and accepting these Rules.
7. You are not entitled to enter the Competition if you are resident in a country outside of Sweden. Where this applies, Afound's invitation to enter the Competition in such country and/or jurisdiction is withdrawn.
8. Afound reserves the right to verify the eligibility of all entrants. Afound also reserves the right to disqualify and remove any entries based on suspicion of infringement of any third party rights or if Afound has reasonable grounds to believe the entrant has breached any of the Rules.
Competition Entries
9. By uploading a photo of your best interior gem and motivate why with the hashtag #malenebirgerafound, on Instagram, you enter our Competition.
10. Only Entries submitted via Instagram, which include an image, the hashtag #malenebirgerafound, and submitted by the Competition's closing date and time, are accepted. Proof of sending your Entry cannot be accepted as proof of delivery, and Afound shall not be responsible for Entries not received for whatever reason.
11. By entering the Competition, you hereby warrant that all information submitted by you is true, current and complete. You also warrant that you own all rights in and to your Entry and that you have permission from any person/s appearing in your Entry.
12. There is no purchase requirement to enter the Competition.
13. Multiple Entries are not accepted.
14. Afound has the right to, at its sole discretion, immediately remove any material deemed offensive.
Judging
15. Entries will be judged by a team of 3 Afound employees at the head office in Stockholm, ("Judges"). Entries will be judged on their creative motivation when choosing the winners. The Competition is a game of skills and chance plays no part in the selection of the winner.
16. Fifteen (15) winners will be chosen by the Judges (the "Winners").
Prizes
17. The Winner wins a limited edition poster, made by Malene Birger exclusively for Afound, including costs for home delivery (the "Prize"). The Prize is worth approximately 1000 SEK.
18. The Prize is not transferable or exchangeable and cannot be redeemed for cash. For the avoidance of doubt, the Prize cannot be returned nor exchanged in any of Afound's stores or online.
19. The Prize is awarded at Afound's discretion and no prize will be awarded as a result of improper actions by or on behalf of any entrant. Afound, acting reasonably, reserves the right not to select a winner.
20. The Winner will be notified via Instagram. The Winner needs to claim the Prize and submit additional information as requested by Afound within 72 hours of receiving the notification via email. Return of any prize notification as undeliverable, failure to claim the Prize within this time or failure to submit additional information may result in disqualification and selection of an alternate winner.
21. Afound cannot be held responsible for any costs associated with winning the Prize, else than what is specified in the Rules. If costs such as taxes or loss of income would arise as a result of winning the Competition, they shall be covered by you.
Intellectual Property Rights & Use of Entrie
22. You specifically grant Afound a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to moderate and use your Entry on any of Afound's marketing channels, including but not limited tothe right for Afound to publish a post on Instagram mentioning your username as the Winner.
23. The Entries and associated usernames will be public to all. By entering the Competition and accepting the Rules you agree your Entry can be broadcasted via digital feeds.
24. By entering the Competition and accepting the Rules, you agree that Afound may use your personal details for the purpose of conducting the Competition, including the use of your Instagram username.
25. By entering the Competition, you give Afound permission to contact you via Instagram if you are the Winner and to use your username on Instagram to announce the Winner/s on Afound's Instagram account. Afound will not add the Winner or any entrants to our mailing list.
Limitation of Liability
26. Afound will not be liable for any system failure or malfunction of www.afound.com or Instagram or any consequences thereof.
27. Afound accepts no liability for any loss, damages or disappointment arising from entering the Competition or in any other way relating to the Competition, except for any liability which cannot be excluded by law.
Jurisdiction
28. The Competition and Rules will be governed by Swedish law and any disputes will be subject to the exclusive jurisdiction of the courts of Sweden. If you access the Competition outside of Sweden, you are responsible for compliance with all local laws.

Var lagrar vi dina uppgifter?
De uppgifter som vi samlar in från dig lagras inom det europeiska ekonomiska samarbetsområdet (EEA), men kan även överföras och bearbetas i ett land utanför EEA. All sådan överföring av dina personuppgifter sker i enlighet med gällande lagstiftning.

Vem har tillgång till dina uppgifter?
Dina uppgifter kan delas inom H&M-gruppen (för information om företag i H&M-gruppen, se vår årsrapport som finns på about.hm.com). Afound fungerar endast som registerförare och behandlar personuppgifterna för det svenska bolagets räkning.
Vi vidarebefordrar, säljer eller byter aldrig dina data för marknadsföringsändamål till tredje part utanför H&M group. Uppgifter som vidarebefordras till tredje part används endast för att vi ska tillhandahålla våra tjänster till dig. Du hittar de olika kategorierna av tredje part under varje enskild process nedan.
På vilken rättslig grund behandlas uppgifterna?
Varje gång vi behandlar personuppgifter som vi samlar in från dig informerar vi dig om huruvida tillhandahållandet av personuppgifter är lagstadgat eller obligatoriskt för att ingå ett avtal och huruvida det är obligatoriskt att tillhandahålla personuppgifterna och eventuella konsekvenser om du väljer att göra det.

Det innefattar endast de personuppgifter du har delgett oss.
Rätt till rättelse:
Du har rätt att begära rättelse av dina personuppgifter om de är felaktiga, inbegripet rätten att komplettera ofullständiga personuppgifter. Om du har ett Afound konto kan du redigera dina personuppgifter på sidorna för ditt konto.
Rätt till radering:
Du har rätt att när som helst radera alla personuppgifter som behandlas av Afound med undantag av följande situationer
• Du har ett pågående ärende med kundservice
• Du har en pågående order som ännu inte har skickats eller delvis har skickats
• Du har en obetald skuld hos Afound, oberoende av betalningsmetod
• Du misstänks för att ha eller har missbrukat våra tjänster under de senaste fyra åren
• Om du har gjort inköp sparar vi dina personuppgifter i anslutning till transaktionen i bokföringssyfte
Din rätt att neka till behandling av personuppgifter på grund av ett legitimt intresse:
Du har rätt att neka till behandling av dina personuppgifter som baseras på Afound:s legitima intresse. Afound fortsätter inte att behandla personuppgifterna såvida vi inte kan visa på ett legitimt skäl till processen som går före dina intressen och rättigheter eller på grund av rättsliga anspråk.
Din rätt att neka till direktmarknadsföring:
Du har rätt att neka till direktmarknadsföring, inklusive profilanalyser som görs i direktmarknadsföringssyfte.
Du kan välja bort direktmarknadsföring på följande sätt:
• Följ instruktionerna i varje marknadsföringsutskick
Rätt till begränsning:
Du har rätt att kräva att Afound begränsar hanteringen av dina personuppgifter under följande omständigheter:
• Om du motsätter dig behandling av dina personuppgifter med utgångspunkt i Afound:s:s legitima intresse, ska Afound begränsa alla hantering av uppgifterna under pågående utredning av legitimt intresse.
• Om du har hävdat att dina personuppgifter är felaktiga måste Afound begränsa all hantering av dessa uppgifter under pågående utredning av huruvida personuppgifterna är korrekta.
• Om behandlingen av personuppgifterna strider mot lagen kan du motsätta dig att personuppgifterna raderas och istället begära begränsning av användningen av dina personuppgifter
• Om Afound inte längre behöver personuppgifterna men det krävs för att du ska kunna försvaa dig mot rättsliga anspråk.

TÄVLING
Varför använder vi dina personuppgifter?
Vi behandlar dina uppgifter när du deltar i våra tävlingar. Dina personuppgifter används för att Afound ska kunna kontakta tävlingsdeltagarna om tävlingen, före och efter ett evenemang, för att identifiera tävlingsdeltagarna, för att verifiera tävlingsdeltagarnas ålder, för att kontakta vinnarna samt för att skicka ut och följa upp utskick av priser.

Vi hanterar följande kategorier av personuppgifter:
• Användarnamn, namn, telefonnummer, hemadress.
• Information som skickas in till tävlingen
Vem har tillgång till dina personuppgifter?
Uppgifter som vidarebefordras till tredje part används endast för att tillhandahålla de tjänster som anges ovan till våra partners eller transportföretag.
Hur länge sparar vi dina uppgifter?
Vi sparar dina personuppgifter i 7 dagar efter att tävlingen har avslutats.

Du har rätt att när som helst dra tillbaka medgivandet till behandling av personuppgifter. Om du gör det kan inte Afound tillhandahålla de tjänster som anges ovan till dig.
